Safety Data Sheets (SDS)

It is a requirement in all EU member states that importers and sellers of chemical substances and/or products intended for professional use shall assess whether the product must be accompanied by a safety data sheet in order to meet European and national legal requirements

Requirements to SDS

Legislation governing SDS has been changed and extended in the course of time. Today, all SDS must comply with the Regulation (EC) No. 1907/2006 of the European Parliament and of the Council (also known as REACH). At the present moment a draft amendment of Appendix II has been made. This draft suggests, for instance, adaptations to §§ 2 and 15 of SDS and a number of other measures.

CLP/CLaP – New hazard symbols/pictograms and new warning and precautionary statements

Products and preparations are currently labelled in accordance with the Directive 99/45/EC of the European Parliament and of the Council (in Denmark introduced by Directive No. 329 of 16 May 2002).

As per 20 January 2009 the EU introduced a new classification and labelling system (CLaP – Classification, Labelling and Packaging). This new system and the 30th and 31st adaptations to the harmonised list of dangerous substances will have great implications for your MSDS.

The new system entails drastically changed labelling requirements. Hazard symbols will be changed, R-phrases will be replaced by H-phrases, and S-phrases will be replaced by P-phrases.

CLaP will be in force concurrently with the familiar EU classification and labelling system throughout a transitional period until 1 June 2015.

Substances shall be classified according to the CLaP Directive by:
1 December 2010

Preparations shall be classified by:
1 June 2015

For a product SDS this means that new classifications have to be added in § 3 and, throughout the transitional period until 1 June 2015, product labelling may be done either according to the classification and labelling requirements of the Danish Environmental Agency (the “old rules”) or according to CLaP.

Danish special law

Danish special laws will be effective concurrently with the new regulations – e.g. requirements for solvents, the Danish Cancer Directive, MAL code, young people’s work, product registration with the Danish Working Environment Authority, workplace safety instructions, etc.
